Transfer of Debts.


Banking regulations did not allow for trading in debt. This is the Gujarat High court  judgement.

Banks cannot  trade transfer or purchase a pool of non performing asset or bad debt.Thus securitisation loses its meaning. Debt cannot be transferred without the borrower  being  party of the transaction.The court has researched in depth and found out that under section 6 trading in debt is not within the purview of banking company.  The impact is wholesome . The banks cannot ,hereafter simply shed their debt box as dry leaves fall from the tree. They have to carry the bag with them.

Is a loan item of the borrower an asset of a bank or debt of a bank?This has to be studied carefully. From a layman’s point of view the loan of a borrower is a debt not an asset. But the bank’s term the faltering companies as Non performing asset. The situation is little peculiar . How can the banks address a loan as an asset?. So far we have blindly followed the bank’s regulations, The judgement of the Gujarat High court is an eye opener. This will have a retrospective effect too.

Selling a debt to Asset Reconstruction Company will also have a similar reference . The ARCIL is a company formemed by different banks, Its regulations and rules ,as found in their Memorandum ,will also definitely reflect the distinctions as found in Bank’s strictures.

The Supreme court can set aside the judgement, but the ruling of the Gujarat High court is an evolution of a thorough analysis of the laws and formulas that govern the financial institutions.

If the judgement is upheld by the Supreme Court of India, then the entire scenario of Non performing Assets under the DRT, under Securitisation (SARFESI ACT)  wil produce a remarkable challenge to the banks autocratic behaviour. It will a stimulate the depressed industrial dogma , and rejuvenate the dishevelled manufacturing premium .

Times change.  Rules get modified. Profiles undergo moderation. Perceptions get altered. But  true Judgements provide a certainity and a memorable requisite and a required respite.

The Spiteful Entities


The world has become so small.  The mind of man has also shrunk to a nominal  clature. This syndrome is fortunately unfortunate.

 The modes of travel, the methodsof  of communication, the  symptoms of outsourcing, the opportunities  of business, and the endeavours of education have grown abnormally predicting a close network capable of proximity and progress.. But all these prerogatives, have explicitly unravelled  the narrow perception of man.

The growth external has not shown an inner strength,  has halted an internal spectrum of promotion  and has curtailed the affable outlook.

The basic quality of feigning malice has taken firm roots.It is an extraneous task to kill this instinct.

There are a handful of people ,who show extreme compassion , who  act with sincere ideals, who shun ostentation, who help others, who  talk gently, who help liberally and who do not expect any reciprocals. These few ,are termed as fools  by the majority, called as ignorant imbeciles by the faddish, and innocent souls by the milder retinue.

The most celebrated  refuse to accept  the prosperity of others. They wish to remain the masters,and dictate terms to the modest . The most influential abhor to deal with  the pragmatic and harm the humble if they come out successful. The most powerful discard the fellow humans as non entities and cause destruction by annihilating their competitors.

The mind spites every deed of the fellow human , as though he is an arch rival. A simple promotion  evokes  ill feeling. A trivial matter , like a hike in pay emulates envy. A purchase of a car or a jewellery or a property  for that matter,ignites the mind. A marriage alliance is enough to set fire. A peaceful existence is sufficient to provoke antagonism. An ordinary settlement kindles the spirit . The gossip , the introspection , the back talk and the frenzy  make the scenario unpleasant and unfit to coexist.

As the world moves, man has to keep pace with it .If he falters ,the orbit will shove him down disgracefully .

Divorces So Quick.


I happen to be in my native place for a couple of days , last week.It was a pleasant get together, meeting young and old, exchanging niceties and enquiring about their health.

It was a hectic schedule  dotted by interesting  information. One peculiar thing , I found during this sojourn was cases of divorce. My place is  known for its conservative ideologies and is steeped in traditional customs. In this modern age , a place like my own ,will stand out for its regulations and discipline. To hear about divorce ,in such a place sounded sacrilegious to me. Yet ,there were many incidents of the legal separation.

Dissolving the marriage , once regarded as a transgression, has become an accepted form now. The reasons for severance, looked appaling  in certain cases, appeared deep in others, but most exhibited flimsy and frivolous sentiments ,that could have been well avoided , if little measure of endurance was pushed in.

Th firm attributes for dissolution is impotency and behavioural tendency. The impotency factor  if found true, the marriage will not be able to go further. But , if it is listed falsely ,then strong counselling has to be activated and unity should be advised. The behavioural factor of excessive smoking, consuming spurious drinks, and addiction to drugs are also cited as causes for separation. The excess could be minimised by tending the eccentricity in a plausible manner and exploring possible ways to stop the practice.

Other minor  evidences of coming late after work, looking after parents, living in a joint family, spending time with friends and taking life easily are simple disturbance ,which should be discussed by the concerned . A way out , or a remedy could be easily tracked and adjustments can be accommodated suitably.

I came home with the usual well being , which I develop when I visit my people, but this time , I felt , the pride ,of my homeland ,as a class apart from the rest of the world,  has been lost. It has also got diffused with the multitude,totally vanished in the fumes.

I feel sad , and am extremely pained to be a silent spectator in this narrow world od envy, deceit ,self conceit, greed and prejudice.

Divine Float.


The celestial couple Lord Subramania and his escort Deivanai had an outing in the Theppam of Thiruparangkundram.

The couple were decked in glittering jewellery,and clothed in colourful Kanchipuram silk.The water body or Theppam was lit with diyas. There was a display of fireworks,which added charm to the float.

The Nagarathar community of Tamilnadu hosted this divine festival. Prasadams were distributed to the devotees from the Nagarathar choultry.Nattukottai Chettiars ,otherwise called as Nagarathars,are known for their generous contribution to the temples.

The float was a beautiful event. The Divine consorts were kept in the float,with the Nagarathar community heads ,the chair person of the temple and the archakas,all getting into the make shift float.The temporary structure of the float looked  archaic , uneven and appeared little risky. The authorities of the temple have to get into the details and modify the float ,to suit the modern times . The risk factor should be eliminated. If any untoward incident  happens , it will  not augur well.

The couple were taken to the central mandapam. They went through three pradishnams . Then they were placed in the oonjal or swing.

 The temple singer or odhuvar sang hymns in praise of Lord ,followed by the recital of the temple Nadashwara vidwans. The singing and the music played by the vidwans were so enchanting and a treat to the ears and a solace to the mind. Aarathis were taken and the final poornaathi was performed amidst the chanting of Murga, Murga, Murga . The crowd  became ecstatic . The devotees were enthralled.  Sublimity took control of the scenario. After going through the Theppam thrice, the float came to  a grand halt.

It was an austere celebration devoid of ostentation. It was a grandeur  without artificial distinction. It was  celestial denouement filled with purity and devotion.

Admire The Taxpayer


Bankers are the heroes of capitalism.Taxpayers are the saviours of the same concept.

The banks collapse has become a weekly event. Every Friday ,we hear about a failure. Fridays can be termed as Collapse Friday ,similar to Ash Wednesday.

This trend of failures and gloom have haunted the world for a period of  a year and a half.To supplement the immense losses made by the Banking geniuses, the taxpayers are entrapped..The government is pushing out a bail out plan to rescue the privately run financial institutions. So public money goes into private equities but without any ownership, without any control, without any regulation.

Does it not sound odd? Does it not appear ridiculous? Does it not look out of context?Does it not indirectly hint that the administration is favouring the private bosses?

Well, we have to as a  tax payer, put up with all these irregularities, endure the seemingly fair proposition which is virtually a drab on our finance.The subsidy, as shown,  by the government in the form of  valuation models,not as market price will fetch the stockholder and the tax payer  virtusllynothing, exactly a zero in value.

Obama’s outrage over the subject of bonus, also is  an apparent mis guided tempo. His stern voice is taken as  whimper by the Wall Street bourgeoise.It  is not a serious call, but a pretentious announcement.A suuccessful banker wants to share the profits,  likes to get a percentage for his hard work. It is a valid desire.The same banker, when his institution makes loss, does not want to accept the failure. If he volunteers to share in the loss and gives back a percentage for non performance, he should be sanctified.Will any of the high ranked officials offer to do so? The burden falls on the tax payer’s shoulder.

Rate Cuts


The economic slowdown has forced all the financial institutions to realise the status of  business.

It has reopened the Pandora’s Box. Out emerge the frauds, cheats, misappropriation, rigging, fudging and collapse.

The lobbyists, the politicians,and the chief executives have gained in the process , by looting the nation.

The banks have been advised to cut the interest rates to promote business.To make the nation prosperous ,we need steps severe. Rate cut is a welcome sign.Industries and business have to come out of the blue. Diminishing the interest rate will help the manufacturing projects . Banks should also extend facilities to them. At present banks have restricted their sanctions, as they fear the competitiveness of industries.

Easy finance with facile rates will give a jump to business. The sanctions should be planned according to the merit of the case.Scrutinising the projections,developing a rapport with the promoters,investigating the background of the people behind,are all necessary etiquettes that the bankers should take care off. Once they are satisfied with these formalities ,the loans should be advanced at the earliest, with comfortable progressions and schedule.

Regulations should be switched on, but the supervision should be subtle ,not stifling and suffocating.A regular flow of funds ,with nominal interest will enthuse the indusries. They will repay the loan with interest in appointed hour .

We look forward for similar outright remittance and free business not limited by deceit and control.

A Little More Magnanimity.


The best in us can be transcribed in many noble deeds and helpful indications.Being good at heart  is a loving  edict. But extending the generosity is a beautiful event.

Many of us are kind . Many of us are compassionate. Many of us are liberal. Many of us are large hearted. These are all but abstract condiments. Feeling is different from doing. Experiencing is alien from performing.

How many of us involve  ourselves in social emancipation?How many of us take up to help the needy? How many of us organise rehabilitation centre for the victims of natural fury?

Well, to engage in such humanitarian consideration, we do need a big background and loads of money.The minimum requirements  are a thought and the impulse to help others. The initiative dwindles , if we do not swing into immediate action. As the desire to help others crystallises  in our mind ,we must jump into it and   execute it. Deliberation leads to procrastination ,which in turn proceeds to denial.

A kind word to a child, a pep talk to an invalid,a caressing touch to a  bruised person, a gentle lead to the  visually challenged, an impressionistic sign language to the  hearing impaired, a writing module for the taciturn, and an allowance to the mentally retarded, will go a long way to create a congenial .carousing environment.

A gentle direction to the physically handicapped, a fresh attestation to the downtrodden, a multiple mandatory affirmation for the depressed ,will evoke a magnificent marvel and an extraordinary exhilaration .

Shall  we all try to effuse a little more magnanimity ,when occasions compel us?

Obama Intrigued


Obama  is outrageous. His temper is aroused by the issue of bonus to executives of top companies. The bonus part is highly disturbing, and the expectation of these  officials  borders on greed

The economy of the nation is in deep trouble.The companies are making huge loss. There is wide spread wage cut and severe hit on jobs. When everything else is in amiss, the bonus claim by the high ranked officers is demanding and demeaning.

The argument ,put forth by the companies , is that such priorities have to be taken into consideration to retain talent. This objective seems to be baseless and flimsy. Talent is plenty.It is available readily . It can be hired for a lesser pay packet.

The tag of high profile has submerged with  failed economy. Professionalism  has not reached the goal. It has turned way ward. it is clueless . Its target is exclusiveness in pay and perquisites. The sincerity in tending the company, in working for the betterment of their protege,in setting right the earnings,and caring for the welfare of the employees  is totally nil.

The deteriorating standards in management has forced us to put down our heads in shame.Instead of remorse and repentance ,the executives in plum posts demand high salary and higher bonus. . It is a disgrace to the nation , a shame to society and a deformity  to man.

Ridiculous Excited Illness.


I have heard of air pollution, noise pollution,water  pollution, coal pollution,light pollution , but very faintly about  visual  pollution.

Air pollution is the introduction of chemicals,particulate matter or biological materials that cause harm or discomfort to humans or other living beings.

Noise pollution is difficult to define. Noise causes strain,which is a leading cause to suicide and illness.Noise is transient, once the noise is stopped the harm vanishes. It is much different from other pollutants that are introduced into the soil ,air or water.Excess  noise may damage human hearing. But the effect varies according to individuals.

Light pollution has caused unnatural effects. The stars have disappeared from the skies, migration of birds are advanced or delayed by the artificial light.

The contamination of river bodies, lakes ,ponds , oceans and groundwater by human activities is called  water pollution.

Light pollution is an ancillary of industrial revolution. With the advent of industries came all modern gadgets.

Visual pollution is one that offends the eye and impacts our overall well being.It centeres around landscape , or building that the community relents to see.

A particular visual affliction today in Madurai , in Tamilnadu , India , is the hoardings displayed in all the main roads, streets, lanes, bridges and most vantage points. Every year ,this historic city , is pushed into ridiculous excitement, by the ruling party, Dravida Munnetra kazhagam party men. The revelry is the outcome of the birthday  celebration of the party leader Alagiri,. Third week of January is a festive occasion for the party. The posters of Alagiri are devastating.

Alagiri  smiling in starched dhoti, Alagiri with his son , with his daughter, with his brother, and with his famous father Karunanidhi, is seen almost everywhere. Today Madurai exhibits Alagiri in all directions, with praised verses, and epithets, calling him a lion , an emperor, a promosing leader.

The epicurean culture is disgusting. The excitement is unnecessary .The cause for such outlandish exhibitions looks frivolous. The outrageous behaviour is stupefying, Year after year ,such revelry seems to be an wasteful expenditure. By and large the city of Madurai , and the people of Madurai, feel the discomfort to the core, experience the discordance to the maximum .The harmony of the quiet city is dissipated , leading to extraneous  irrelevance and  relative morbidity
